  • Receiving services coordinated through Home Optical;

  • Purchasing eyeglasses, lenses, contact lenses, sunglasses, accessories, repairs, or other products;

  • Providing a prescription;

  • Using insurance or vision benefits;

  • Making a payment; or

  • Communicating with us through our website, telephone, email, text message, or social-media accounts.

These Terms contain important provisions concerning:

  • Prescription verification;

  • Custom-made products;

  • Deposits and cancellations;

  • Insurance estimates;

  • Mobile visits;

  • Returns, remakes, and warranties;

  • Disclaimers;

  • Limitations of liability;

  • Dispute resolution; and

  • Governing law.

By accessing or using the Home Optical website, you agree to the Website Terms of Use contained in these Terms.

The Terms and Conditions of Sale and Service apply when they are:

  • Presented or made available before or during a transaction;

  • Linked from an order form, estimate, invoice, receipt, appointment confirmation, or checkout page;

  • Incorporated into a written or electronic agreement; or

  • Otherwise accepted by you in connection with a purchase or service.

  • Adjustments and repairs;

  • Contact-lens products where permitted;

  • Insurance and vision-benefit processing;

  • Appointment scheduling;

  • Mobile optical visits;

  • Eye examinations coordinated with licensed eye-care providers;

  • Tele-optometry services coordinated through third-party providers;

  • Eyewear delivery or pickup; and

  • Related optical products and services.

The exact products and services available may change without notice.

2. Definitions

For purposes of these Terms:

“Clinical Services”

“Clinical Services” means eye examinations, refractions, medical evaluations, diagnoses, prescriptions, screenings, testing, clinical recommendations, and other professional healthcare services performed by a licensed optometrist, ophthalmologist, telehealth provider, or other licensed healthcare professional.

“Custom Product”

“Custom Product” means a product manufactured, modified, ordered, prepared, or personalized for a particular customer or patient, including:

  • Prescription lenses;

  • Eyeglasses containing prescription lenses;

  • Special-order frames;

  • Prescription sunglasses;

  • Custom lens tints or coatings;

  • Prism lenses;

  • Progressive lenses;

  • Bifocals or trifocals;

  • Specialty optical devices;

  • Products prepared using a customer’s measurements;

  • Products altered to accommodate a prescription; and

  • Other personalized or specially manufactured products.

“Products”

“Products” means eyewear, lenses, frames, sunglasses, contact lenses, accessories, cleaning products, cases, replacement parts, repairs, and other merchandise offered by Home Optical.

“Services”

“Services” means the Home Optical website, scheduling services, mobile services, optical dispensing services, product-related services, communications, and any Clinical Services coordinated through Home Optical.

“Website”

“Website” means Home Optical’s website and any webpage, portal, form, scheduling page, or online feature controlled by or provided on behalf of Home Optical.

“You” and “Your”

“You” and “your” refer to the website visitor, customer, patient, purchaser, parent, guardian, responsible party, insurance subscriber, authorized representative, or other person using the Website or purchasing or receiving Products or Services.


3. Eligibility and Authority

You must be at least 18 years old and legally able to enter into a binding contract to make a purchase or accept these Terms independently.

A minor may receive Products or Services when permitted by law and with the involvement and authorization of a parent, legal guardian, or other legally authorized representative.

By scheduling an appointment, placing an order, or purchasing for another person, you represent that:

  • You are legally authorized to act for that person;

  • The information you provide is accurate;

  • You have permission to provide the person’s prescription, health, contact, insurance, and payment information; and

  • You accept financial responsibility to the extent stated in the transaction documents.

The Website is intended primarily for users located in the United States. Home Optical does not represent that its Website, Products, or Services are appropriate or legally available in every jurisdiction.


4. Relationship With Licensed Healthcare Providers

Home Optical may coordinate Clinical Services with licensed optometrists, ophthalmologists, tele-optometry providers, or other healthcare professionals.

Clinical Services may be provided:

  • In person;

  • Through tele-optometry;

  • Through another telehealth arrangement;

  • Through 20/20 Now or another third-party platform;

  • By a provider who is not an employee of Home Optical; or

  • Through a professional entity legally separate from Home Optical.

Unless expressly stated otherwise in writing:

  • The licensed provider is independently responsible for professional judgment;

  • The provider determines whether an examination can be completed;

  • The provider determines whether a prescription can be issued;

  • Home Optical does not control clinical findings, diagnoses, or treatment recommendations;

  • Home Optical cannot guarantee that an examination will result in a prescription;

  • The provider may maintain the official medical or examination record;

  • The provider may issue separate consents, notices, privacy practices, or terms; and

  • Questions concerning clinical findings should be directed to the licensed provider.

Nothing in these Terms authorizes Home Optical or an unlicensed person to diagnose, prescribe, alter a prescription, or perform professional services outside the lawful scope of practice.


5. Medical Emergencies

Home Optical and its Website are not emergency medical services.

Do not use the Website, email, text messaging, social media, or ordinary voicemail to report a medical emergency.

Seek immediate medical attention or call 911 when appropriate if you experience symptoms such as:

  • Sudden loss of vision;

  • Serious eye injury;

  • Chemical exposure;

  • Severe eye pain;

  • Sudden flashes or a significant increase in floaters;

  • A curtain-like loss of vision;

  • Severe redness accompanied by pain or vision loss; or

  • Any other urgent or potentially life-threatening condition.

Information on the Website is general information only. It is not a diagnosis, medical opinion, prescription, or substitute for an examination by a qualified healthcare professional.


PART II — WEBSITE TERMS OF USE

6. Limited Permission to Use the Website

Subject to these Terms, Home Optical grants you a limited, personal, revocable, nonexclusive, nontransferable right to access and use the Website for lawful personal purposes.

This permission does not transfer ownership of the Website or any content to you.

You may not use the Website for an unauthorized commercial purpose or in a way that damages Home Optical, another person, the Website, or any related system.


7. Intellectual Property

Unless otherwise stated, the Website and its contents are owned by, licensed to, or lawfully used by Home Optical.

Protected content may include:

  • The Home Optical name;

  • Logos;

  • Slogans;

  • Text;

  • Photographs;

  • Videos;

  • Graphics;

  • Illustrations;

  • Layouts;

  • Designs;

  • Forms;

  • Software;

  • Icons;

  • Product descriptions;

  • Educational material;

  • Marketing material;

  • Website organization; and

  • The selection and arrangement of content.

The Website and its contents may be protected by copyright, trademark, trade-dress, unfair-competition, and other laws.

You may view and print reasonable portions of the Website for personal, noncommercial use. You may not, without prior written permission:

  • Copy substantial portions of the Website;

  • Republish Website content;

  • Modify or create derivative works from Website content;

  • Sell, license, or commercially exploit Website content;

  • Remove copyright, trademark, or ownership notices;

  • Use Home Optical’s name or branding in a misleading manner;

  • Frame or mirror the Website;

  • Use Website content to train an artificial-intelligence or machine-learning system;

  • Scrape or extract Website data using automated tools;

  • Impersonate Home Optical; or

  • Suggest that Home Optical sponsors or endorses you without written authorization.

Names and logos belonging to manufacturers, insurers, tele-optometry providers, and other third parties remain the property of their respective owners.


8. Prohibited Website Conduct

You agree not to:

  • Use the Website for an illegal, fraudulent, harmful, or abusive purpose;

  • Submit false, misleading, incomplete, or impersonated information;

  • Attempt to access another person’s records or account;

  • Misrepresent your identity or authority;

  • Upload malware, viruses, or harmful code;

  • Interfere with Website security;

  • Circumvent access controls;

  • Test Website vulnerabilities without written permission;

  • Overload or disrupt the Website;

  • Use bots, crawlers, scraping tools, or automated purchasing systems without permission;

  • Harvest names, email addresses, telephone numbers, or other information;

  • Submit another person’s prescription or health information without authority;

  • Submit a forged, altered, expired, or fraudulent prescription;

  • Use the Website to harass or threaten another person;

  • Violate intellectual-property, privacy, publicity, or other rights;

  • Post obscene, defamatory, discriminatory, or unlawful material;

  • Use the Website to advertise an unrelated business;

  • Attempt to obtain Products through fraud, stolen payment information, or unauthorized insurance benefits; or

  • Assist another person in any prohibited conduct.

Home Optical may restrict or terminate Website access when we reasonably believe these Terms have been violated.


9. Accounts and Login Credentials

Home Optical may offer customer accounts, patient portals, scheduling accounts, or other login-protected features.

When using an account, you agree to:

  • Provide accurate information;

  • Maintain current contact information;

  • Create secure login credentials;

  • Protect your password;

  • Restrict access to your device;

  • Avoid sharing credentials;

  • Notify us promptly of suspected unauthorized access; and

  • Accept responsibility for activity performed through your account to the extent permitted by law.

Home Optical may:

  • Require identity verification;

  • Reject an inappropriate username;

  • Reset credentials;

  • Suspend an account;

  • Restrict access;

  • Close an account; or

  • Preserve account records when required for legal, healthcare, insurance, fraud-prevention, or business purposes.

Closing an online account does not necessarily require deletion of records that Home Optical or a healthcare provider must retain.


10. Accuracy of Website Information

Home Optical tries to provide useful and accurate information. However, mistakes, omissions, delays, and outdated information may occur.

Website information may change concerning:

  • Prices;

  • Product availability;

  • Frame colors;

  • Frame sizes;

  • Materials;

  • Lens options;

  • Insurance participation;

  • Promotions;

  • Appointment availability;

  • Examination availability;

  • Delivery estimates;

  • Business hours; and

  • Service areas.

We may correct an error at any time.

If a material error affects an order, Home Optical may:

  • Contact you for instructions;

  • Correct the order;

  • Offer an alternative;

  • Cancel the affected portion of the order; or

  • Issue an appropriate refund.

Images are for illustration. Actual colors and appearance may vary because of:

  • Screen settings;

  • Lighting;

  • Manufacturing variations;

  • Photography;

  • Image editing;

  • Frame size;

  • Facial proportions; and

  • Product updates.

A virtual image, photograph, or online measurement is not a guarantee that a frame will fit or appear exactly as displayed.


11. User Submissions, Reviews, and Photographs

You may submit reviews, comments, feedback, suggestions, photographs, or other content where permitted.

You retain ownership of content you lawfully own. By submitting content for publication, marketing, or promotional use, you grant Home Optical a nonexclusive, worldwide, royalty-free license to:

  • Store;

  • Reproduce;

  • Display;

  • Publish;

  • Format;

  • Resize;

  • Distribute; and

  • Use the submitted content for the purpose for which it was provided.

This license does not authorize Home Optical to publish confidential patient or medical information without appropriate authorization.

You represent that:

  • You own the content or have permission to submit it;

  • The content is accurate to the best of your knowledge;

  • The content does not violate another person’s rights;

  • Anyone identifiable in a submitted photograph has consented;

  • You have appropriate authorization for any identifiable minor; and

  • The content is not fraudulent, defamatory, threatening, obscene, or unlawful.

Do not include prescriptions, insurance numbers, medical records, payment-card information, or other sensitive information in a public review or comment.

Home Optical may moderate, decline, remove, or stop displaying user content, but is not obligated to monitor every submission.

Private medical, insurance, payment, or appointment communications will be handled under applicable privacy practices and are not treated as public user submissions.


12. Copyright Complaints

Home Optical respects intellectual-property rights.

A person who believes that material on the Website infringes a copyright may send a written notice containing:

  • Identification of the copyrighted work;

  • Identification and location of the allegedly infringing material;

  • The complaining party’s name and contact information;

  • A statement of good-faith belief that the use is unauthorized;

  • A statement that the information provided is accurate;

  • A statement, under penalty of perjury, that the complaining party owns the copyright or is authorized to act for the owner; and

  • A physical or electronic signature.

13. Third-Party Websites and Platforms

The Website may link to or interact with third-party services, including:

  • Tele-optometry platforms;

  • Licensed provider portals;

  • Insurance websites;

  • Payment processors;

  • Appointment systems;

  • Financing providers;

  • Mapping services;

  • Social-media platforms;

  • Manufacturers;

  • Optical laboratories;

  • Delivery providers; and

  • Review websites.

Third-party services may have separate terms and privacy policies.

Home Optical does not control and is not responsible for:

  • Third-party website availability;

  • Third-party security;

  • Third-party content;

  • Independent clinical decisions;

  • Insurer determinations;

  • Payment-processor actions;

  • Delivery-carrier actions; or

  • Products and services offered independently by third parties.

A link does not necessarily mean that Home Optical endorses every statement, product, or practice of the third party.


14. Website Availability

Home Optical does not guarantee that the Website will always be:

  • Available;

  • Uninterrupted;

  • Secure;

  • Error-free;

  • Compatible with every device; or

  • Free of harmful components.

We may modify, suspend, restrict, or discontinue any Website feature.

Appointments, orders, prescription submissions, and messages are not necessarily received until acknowledged by Home Optical or the appropriate provider.

Do not assume that an appointment is confirmed merely because you submitted a request.


15. Privacy

Use of Personal Information is addressed in the Home Optical Privacy Policy.

Health information may also be governed by a separate Notice of Privacy Practices issued by Home Optical, an optometrist, a tele-optometry provider, or another healthcare provider.

The Privacy Policy and any applicable Notice of Privacy Practices are incorporated into these Terms by reference to the extent applicable.


16. Electronic Communications

By communicating electronically with Home Optical, you consent to receiving electronic records and communications relating to your inquiry, appointment, transaction, or account, subject to applicable law.

Electronic communications may include:

  • Appointment confirmations;

  • Reminders;

  • Order updates;

  • Pickup notices;

  • Delivery information;

  • Insurance questions;

  • Payment receipts;

  • Requests for information;

  • Policy updates; and

  • Other service-related communications.

You are responsible for maintaining a working email address and telephone number.

Electronic delivery may be affected by:

  • Spam filters;

  • Carrier delays;

  • Device settings;

  • Incorrect contact information;

  • Network failures; and

  • Technical interruptions.

Home Optical is not responsible for delays caused by your carrier, email provider, device, or incorrect contact information.


17. Text Messages

Providing a mobile number may allow Home Optical to send service-related text messages reasonably connected with:

  • An appointment;

  • An examination;

  • An order;

  • Insurance processing;

  • Pickup;

  • Delivery;

  • Repairs;

  • Payment;

  • Customer service; or

  • Another service you requested.

Marketing text messages will be sent only when Home Optical has obtained the consent required by applicable law.

Consent to receive marketing text messages is not a condition of purchasing a Product or Service.

Message and data rates may apply. Message frequency may vary.

You may opt out of marketing text messages by replying STOP or following the instructions in the message. You may request assistance by replying HELP or contacting Home Optical.

An opt-out may not prevent necessary nonmarketing communications when otherwise permitted by law, although Home Optical will use a different reasonable communication method when required.

Mobile numbers and text-message consent will not be sold to third parties for their independent marketing.


18. Call Monitoring and Recording

Home Optical may monitor or record a telephone call only when:

  • Appropriate notice is provided;

  • Consent is obtained when required; and

  • The monitoring or recording is permitted by applicable law.

Home Optical is not obligated to record calls.

A call recording, when made, may be used for quality assurance, training, documentation, security, dispute resolution, or legal compliance.


PART III — TERMS AND CONDITIONS OF SALE AND SERVICE

19. Product and Service Information

Descriptions, samples, estimates, measurements, demonstrations, photographs, and recommendations are intended to help you make a purchase decision.

Because eyewear is affected by individual anatomy, prescription, use, and preference:

  • A frame that looks suitable in a photograph may fit differently in person;

  • Colors may vary;

  • Materials may feel different than expected;

  • Frame measurements do not guarantee identical fit;

  • Lens thickness depends on prescription, frame, material, design, and measurements;

  • Progressive lenses require adaptation and proper positioning;

  • Coatings and lens materials have different benefits and limitations;

  • No lens is completely scratch-proof;

  • No frame is indestructible;

  • “Blue-light,” anti-reflective, photochromic, polarized, tint, and similar features have limitations; and

  • A recommendation is not a guarantee of personal preference or adaptation.

You are responsible for asking questions before approving an order.


20. Prescription Requirements

Prescription eyewear and contact lenses require a valid prescription as required by applicable law.

You agree to provide:

  • A complete and legible prescription;

  • The patient’s correct name;

  • The prescribing provider’s information;

  • The examination or issue date;

  • The expiration date, when applicable;

  • Lens or contact-lens information;

  • Any special instructions;

  • Accurate measurements when you are responsible for supplying them; and

  • Any authorization reasonably needed to verify the prescription.

You represent that a submitted prescription:

  • Was lawfully issued by an authorized prescriber;

  • Belongs to the intended wearer;

  • Has not been altered;

  • Is not fraudulent;

  • Has not expired;

  • Is complete; and

  • May lawfully be filled.

Home Optical may contact the prescribing provider to:

  • Verify authenticity;

  • Clarify handwriting or information;

  • Confirm expiration;

  • Resolve an inconsistency;

  • Confirm contact-lens information; or

  • Obtain other information needed to fill the order lawfully.

Home Optical may decline or delay an order when a prescription is:

  • Expired;

  • Incomplete;

  • Illegible;

  • Internally inconsistent;

  • Suspected of alteration;

  • Outside Home Optical’s lawful scope;

  • Unsuitable for the requested Product;

  • Missing required measurements;

  • Not verified when verification is legally required; or

  • Otherwise unable to be filled safely or legally.

Home Optical will not intentionally alter a prescription.

A spectacle prescription and a contact-lens prescription are not interchangeable.


21. Pupillary Distance and Other Measurements

Prescription eyewear may require measurements such as:

  • Pupillary distance;

  • Monocular pupillary distance;

  • Segment height;

  • Optical-center height;

  • Vertex distance;

  • Pantoscopic tilt;

  • Face-form angle;

  • Frame dimensions; or

  • Other fitting information.

Measurements may be taken by Home Optical when appropriate and permitted.

When you provide your own measurement, you are responsible for its accuracy.

Home Optical may not be responsible for remake costs caused by:

  • An inaccurate customer-supplied measurement;

  • Measurements taken by an unauthorized third party;

  • A changed frame selection after measurements were taken;

  • A prescription change after the order was approved; or

  • Inability to perform an in-person fitting because you declined or were unavailable.

Home Optical may require an in-person or mobile fitting before accepting certain prescriptions, frames, or lens designs.


22. Prescription Release and Copies

When Home Optical is acting only as an optical retailer or dispenser, the prescribing healthcare provider is generally responsible for issuing and releasing the prescription.

Home Optical may assist you in requesting a copy but cannot guarantee how quickly an independent provider will respond.

Where Home Optical or an associated provider is legally responsible for releasing a prescription, the prescription will be handled in accordance with applicable law and the provider’s policies.

A prescription copy does not necessarily include:

  • Measurements taken solely for manufacturing or fitting;

  • Proprietary laboratory calculations;

  • Internal work tickets;

  • Insurance claim records;

  • Clinical notes not included within the prescription; or

  • Information that applicable law does not require to be placed on the prescription.

Nothing in these Terms requires you to purchase eyewear from Home Optical as a condition of receiving a prescription when such a condition would violate applicable law.


23. Eye Examinations and Tele-Optometry

An eye examination may involve a licensed provider located remotely and technology that transmits information for professional review.

By participating in tele-optometry, you understand that:

  • The provider may not be physically present;

  • Electronic equipment and communications will be used;

  • Technology may fail or produce incomplete data;

  • The provider may require additional testing;

  • The provider may decline to issue a prescription;

  • The provider may recommend an in-person examination;

  • Tele-optometry is not appropriate for every patient or condition;

  • The quality of the examination may depend on patient cooperation and equipment performance;

  • A technical failure may require rescheduling;

  • Separate telehealth consent may be required;

  • The patient may need to be physically located in a jurisdiction where the provider is authorized to practice; and

  • The provider is responsible for clinical decisions.

Payment for an examination does not guarantee:

  • A particular prescription;

  • A particular diagnosis;

  • Insurance payment;

  • Eligibility for contact lenses;

  • Clearance for driving, employment, or another purpose;

  • That every eye condition will be detected; or

  • That no further examination will be recommended.

An examination intended primarily for refraction or eyewear may not replace a comprehensive medical eye examination when one is medically indicated.


24. Placing an Order

An order submitted to Home Optical is an offer to purchase Products or Services.

Home Optical may accept or reject an order.

An order is not necessarily accepted merely because:

  • You submitted information;

  • You received an automated message;

  • A payment authorization was obtained;

  • Insurance eligibility was checked; or

  • A preliminary estimate was issued.

Acceptance generally occurs when Home Optical:

  • Confirms the order;

  • Accepts payment or a deposit;

  • Submits a Custom Product for production;

  • Delivers the Product;

  • Performs the Service; or

  • Otherwise communicates acceptance.

Home Optical may decline or cancel an order because of:

  • Product unavailability;

  • Prescription problems;

  • Measurement concerns;

  • Pricing errors;

  • Suspected fraud;

  • Unauthorized payment;

  • Insurance problems;

  • Safety concerns;

  • Service-area limitations;

  • Legal restrictions;

  • Manufacturer or laboratory limitations;

  • Inability to contact you;

  • Inaccurate information; or

  • Another reasonable business or professional concern.

If Home Optical cancels an accepted order without providing the Product or Service, Home Optical will issue any refund required by applicable law, subject to charges for Products or Services already lawfully provided.


25. Order Review and Customer Approval

Before approving an order, review:

  • Patient name;

  • Prescription;

  • Frame;

  • Frame color;

  • Frame size;

  • Lens design;

  • Lens material;

  • Lens coatings;

  • Tint;

  • Contact-lens brand and parameters;

  • Measurements;

  • Price;

  • Insurance allowance;

  • Copayment;

  • Deposit;

  • Expected balance;

  • Pickup or delivery method; and

  • Any special instructions.

You must notify Home Optical immediately if information appears incorrect.

Once a Custom Product has entered production, changes may require:

  • A new order;

  • Additional payment;

  • A laboratory charge;

  • A restocking charge;

  • Loss of a deposit; or

  • Payment of costs already incurred.

Home Optical is not obligated to absorb costs caused by information you approved when the approved information was accurately used.


26. Prices and Pricing Errors

Prices are displayed or quoted in United States dollars unless otherwise stated.

Prices may change without notice before an order is accepted.

The total price may include:

  • Frames;

  • Lenses;

  • Coatings;

  • Tints;

  • Add-ons;

  • Examination charges;

  • Mobile-service fees;

  • Travel fees;

  • Delivery;

  • Repairs;

  • Taxes;

  • Insurance adjustments;

  • Copayments;

  • Deductibles;

  • Noncovered services; and

  • Other disclosed charges.

A typographical, system, insurance, or pricing error does not require Home Optical to sell a Product at an obviously incorrect price.

When a pricing error is discovered, Home Optical may:

  • Correct the price;

  • Request approval;

  • Offer an alternative;

  • Cancel the affected item; or

  • Refund the affected payment.

Home Optical will not increase an accepted order price without explanation, except when:

  • You request a change;

  • The prescription changes;

  • Insurance information changes;

  • A quoted benefit is denied;

  • Additional work is authorized;

  • Taxes or legally required charges change; or

  • The original price resulted from an error that could not reasonably be honored.


27. Payment and Deposits

Payment may be required:

  • At the time of order;

  • Before an examination;

  • Before a mobile visit;

  • Before production begins;

  • At pickup;

  • Before delivery; or

  • According to another written arrangement.

Custom Products may require a deposit or full payment before Home Optical submits the order to a laboratory, manufacturer, or supplier.

A deposit is applied to the purchase price.

Once production or special ordering begins, some or all of the deposit may become nonrefundable to the extent permitted by law because Home Optical may have incurred:

  • Laboratory charges;

  • Manufacturer charges;

  • Shipping charges;

  • Professional time;

  • Custom-material costs;

  • Insurance reversals;

  • Processing charges; or

  • Other nonrecoverable expenses.

Home Optical will disclose material deposit and cancellation terms on the estimate, order form, receipt, or other transaction document.

You authorize Home Optical and its payment processors to charge the payment method you provide for:

  • Approved purchases;

  • Approved deposits;

  • Remaining balances;

  • Authorized changes;

  • Shipping;

  • Applicable taxes;

  • Approved cancellation or no-show fees; and

  • Other disclosed charges.

You represent that you are authorized to use the payment method.


28. Flexible Spending and Health Savings Accounts

Home Optical may accept certain flexible spending account or health savings account payment cards.

Acceptance of the card does not guarantee that a Product or Service is eligible under your plan or tax rules.

You are responsible for:

  • Confirming eligibility;

  • Retaining receipts;

  • Submitting documentation;

  • Responding to plan requests; and

  • Any taxes, penalties, or repayment resulting from an ineligible purchase.

Home Optical does not provide tax advice.


29. Insurance and Vision Benefits

Insurance and vision benefits are agreements between you, the subscriber, the insurer, the benefit plan, and any applicable administrator.

Home Optical may assist with:

  • Eligibility verification;

  • Benefit estimates;

  • Authorizations;

  • Claim submission;

  • Claim correction;

  • Coordination of benefits; and

  • Explanation of available options.

Any statement concerning benefits is an estimate, not a guarantee of payment.

An insurer may later:

  • Deny a claim;

  • Reduce payment;

  • determine that a Product is not covered;

  • Apply a deductible;

  • Apply a frequency limitation;

  • Reject an authorization;

  • Reverse a previously quoted benefit;

  • Require additional documentation;

  • Treat a provider as out of network; or

  • Decide that a Service was not medically necessary or eligible.

You remain responsible for:

  • Copayments;

  • Deductibles;

  • Coinsurance;

  • Noncovered Products or Services;

  • Charges exceeding an allowance;

  • Denied claims;

  • Incorrect insurance information;

  • Benefits already used elsewhere;

  • Coordination-of-benefits problems;

  • Coverage termination;

  • Claim reversals; and

  • Other amounts not paid by the plan.

By asking Home Optical to submit a claim, you authorize Home Optical to provide the information reasonably necessary to process the claim.

Where applicable, a separate assignment-of-benefits or payment authorization may be required.

If an insurer pays you directly for a Product or Service supplied by Home Optical, you remain responsible for paying Home Optical.

Insurance limitations do not change Home Optical’s standard retail price unless required by a provider agreement or applicable law.


30. Chargebacks and Payment Disputes

Contact Home Optical promptly if you believe a charge is incorrect.

Nothing in these Terms prevents you from exercising a lawful payment-card dispute right.

However, submitting a false, misleading, or fraudulent chargeback may result in:

  • Suspension of future services;

  • Cancellation of pending orders;

  • Collection activity;

  • Submission of relevant transaction records to the payment processor;

  • Recovery of amounts lawfully owed; and

  • Other remedies permitted by law.

A chargeback does not automatically cancel an insurance claim, laboratory obligation, custom order, or remaining lawful balance.


31. Appointment Scheduling

An appointment request is not confirmed until Home Optical or the applicable provider confirms it.

You are responsible for:

  • Providing accurate contact information;

  • Arriving on time;

  • Bringing required identification;

  • Bringing insurance information;

  • Bringing current eyewear;

  • Providing prescription information;

  • Bringing a parent, guardian, or representative when required;

  • Completing required forms;

  • Following preparation instructions; and

  • Notifying Home Optical of accessibility or language needs.

Home Optical may reschedule or cancel an appointment because of:

  • Provider unavailability;

  • Equipment failure;

  • Internet or power failure;

  • Weather;

  • Illness;

  • Safety concerns;

  • Incomplete information;

  • Insurance problems;

  • Location problems;

  • Emergencies;

  • Delays outside our control; or

  • Another operational or professional reason.

When practicable, Home Optical will attempt to notify you using the contact information provided.


32. Late Arrivals, Cancellations, and Missed Appointments

Late arrival may reduce the time available or require rescheduling.

Home Optical may establish reasonable:

  • Appointment deposits;

  • Cancellation deadlines;

  • Late-cancellation fees;

  • No-show fees;

  • Mobile travel fees;

  • Setup fees; and

  • Rescheduling requirements.

Any fee must be disclosed during booking, in an appointment confirmation, or in another written or electronic notice.

Unless a different policy is disclosed for a particular appointment:

  • Please provide at least 24 hours’ notice when canceling or rescheduling;

  • Repeated missed appointments may result in advance-payment requirements;

  • A no-show fee does not purchase a future Service;

  • A provider may waive a fee in appropriate circumstances; and

  • Fees remain subject to applicable law and contractual restrictions.

Home Optical may make reasonable exceptions for emergencies at its discretion.


33. Mobile Optical Visits

Mobile visits may be offered at:

  • Homes;

  • Workplaces;

  • Offices;

  • Residential communities;

  • Assisted-living settings;

  • Community organizations;

  • Events;

  • Hotels;

  • Facilities; or

  • Other approved locations.

Mobile service is subject to availability, service area, staffing, provider authorization, equipment requirements, and safety.

By requesting a mobile visit, you agree to provide:

  • An accurate address;

  • A working telephone number;

  • Entry instructions;

  • Parking information;

  • Building or security requirements;

  • A reasonably clean and safe service area;

  • Sufficient lighting;

  • Reasonable space for equipment;

  • Access to electricity or internet when disclosed as necessary;

  • Information about stairs, elevators, pets, hazards, or accessibility restrictions;

  • Permission from the property owner, employer, facility, or host when required; and

  • A responsible adult for a minor or person who cannot legally consent.

Home Optical may decline, stop, or reschedule a mobile visit when:

  • The location is unsafe;

  • A person acts abusively or threateningly;

  • Pets are unsecured;

  • Illegal activity is present;

  • Equipment cannot be used safely;

  • The location is excessively public for the requested service;

  • Required electricity, internet, space, or access is unavailable;

  • The patient is not present;

  • Identity cannot be verified;

  • Required consent is unavailable;

  • The provider determines the Service is inappropriate;

  • Weather or travel conditions are unsafe; or

  • Another condition materially interferes with lawful or safe service.

Travel and setup charges

Mobile-service, travel, parking, toll, or setup charges may apply and will be disclosed before the visit when reasonably practicable.

A travel or setup fee may be nonrefundable after Home Optical has traveled to the location or incurred the related expense, except where law requires otherwise.

Privacy at mobile locations

Home Optical will take reasonable privacy precautions. You acknowledge that Home Optical cannot completely control:

  • Other occupants;

  • Coworkers;

  • Facility staff;

  • Visitors;

  • Public spaces;

  • Noise;

  • Cameras controlled by the property;

  • Building access; or

  • Other environmental conditions.

You are responsible for requesting a reasonably private area and identifying who may participate in the visit.

Home Optical will not intentionally disclose confidential health or prescription information to an employer, host, facility, or other unauthorized person.


34. Statutory Cancellation Rights for Certain Off-Premises Sales

Some transactions completed at a customer’s home or another off-premises location may be subject to federal or state home-solicitation or cooling-off laws.

Nothing in these Terms waives or limits a cancellation right that cannot legally be waived.

When a transaction qualifies for a statutory cancellation right:

  • Home Optical will provide any separate written agreement or cancellation notice required by law;

  • The separate notice will state the applicable deadline and cancellation method;

  • The separate statutory notice controls over any conflicting Custom Product or cancellation provision in these Terms; and

  • Home Optical will process a timely and valid cancellation as required by applicable law.

The existence of mobile service does not mean that every mobile transaction automatically qualifies for a statutory cancellation period. Eligibility depends on the circumstances and applicable law.

A customer exercising a statutory cancellation right must follow the instructions in the cancellation notice.


35. Order Cancellation

Contact Home Optical immediately to request cancellation.

Before production begins

If Home Optical can stop the order before a laboratory, manufacturer, supplier, provider, or other third party begins work, Home Optical may cancel the order and refund the amount paid, less any separately disclosed and lawfully nonrefundable charge.

After production or special ordering begins

Once a Custom Product has entered production or a special-order item has been ordered, cancellation may not be possible.

If cancellation is possible, the refund may be reduced by actual or reasonably allocated costs already incurred, subject to applicable law.

Completed services

Charges for examinations, measurements, adjustments, repairs, travel, fitting, consultation, delivery, and other Services already performed are generally not refundable merely because you later decide not to purchase or use another Product or Service.

Statutory rights

This section does not override any nonwaivable cancellation or refund right.


36. Custom Products and Final-Sale Items

Custom Products are prepared for an individual customer and may have little or no resale value.

Except where otherwise required by law or covered by a written remake, warranty, or satisfaction policy, Custom Products are generally not returnable solely because:

  • You changed your mind;

  • You no longer like the style;

  • You selected the wrong color;

  • You later found a lower price;

  • Another person dislikes the appearance;

  • You did not anticipate lens thickness;

  • You did not adapt immediately to a properly made lens;

  • Your prescription later changed;

  • You supplied incorrect information;

  • You did not follow fitting instructions; or

  • The Product was made according to the approved order.

Other items that may be final sale include:

  • Clearance merchandise;

  • Personalized products;

  • Special-order frames;

  • Opened contact lenses;

  • Opened hygiene-sensitive products;

  • Products damaged after delivery;

  • Used accessories;

  • Products altered by another business; and

  • Items clearly marked “Final Sale.”

This section does not eliminate remedies for a verified defect, fabrication error, misdescription, or other right provided by law.


37. Noncustom Returns

Unless a different written policy is provided at purchase, an unused, noncustom retail item may be considered for return within 14 calendar days after delivery or pickup when:

  • The original receipt is provided;

  • The Product is unused;

  • The Product is undamaged;

  • Packaging is complete;

  • Tags and accessories are present;

  • The item is in resalable condition; and

  • The item was not marked Final Sale.

Home Optical may deny a return when the item:

  • Has been worn;

  • Has been altered;

  • Is scratched or damaged;

  • Is missing packaging or parts;

  • Is contaminated;

  • Is hygiene-sensitive and opened;

  • Was specially ordered;

  • Was paid through benefits that cannot be reversed;

  • Was supplied by a third party with stricter return rules; or

  • Is otherwise excluded under these Terms.

Refunds will ordinarily be issued to the original payment method.

Cash refunds, card refunds, insurance reversals, and benefit restorations may require different processing times.


38. Contact-Lens Returns

Contact lenses are regulated medical devices and require a valid contact-lens prescription.

Opened boxes, trial lenses, individually opened lenses, and damaged packaging are generally not returnable.

Unopened, unexpired, unmarked boxes may be eligible for return or exchange when:

  • The boxes were supplied by Home Optical;

  • The request is made promptly;

  • The manufacturer accepts the return;

  • The prescription and insurance transaction can be appropriately reversed;

  • The boxes are in resalable condition; and

  • The return is otherwise permitted by law and the applicable supplier policy.

Manufacturer restocking, shipping, insurance, or processing charges may apply when disclosed and permitted.

Home Optical does not guarantee that a manufacturer or insurer will accept returned contact lenses.


39. Inspection at Pickup or Delivery

You should inspect Products promptly.

At pickup, you may be asked to:

  • Verify the frame;

  • Verify the lens type;

  • Try on the eyewear;

  • Confirm basic fit;

  • Receive adjustment instructions;

  • Review care instructions; and

  • Sign for receipt.

Notify Home Optical promptly if you believe:

  • The wrong Product was delivered;

  • A Product is visibly damaged;

  • The prescription appears incorrect;

  • A part is missing;

  • The frame is materially different from the approved order; or

  • A manufacturing defect is present.

Delaying notice may make it harder to determine whether a problem existed at delivery or resulted from later use.


40. Eyewear Adaptation

Some customers need time to adapt to:

  • A new prescription;

  • Progressive lenses;

  • Bifocals;

  • Trifocals;

  • Prism;

  • High-index lenses;

  • Changes in astigmatism;

  • Changes in frame size;

  • A different base curve;

  • A new lens design; or

  • A significant prescription change.

Adaptation experiences vary.

Temporary symptoms may include:

  • Distortion;

  • Swim effect;

  • Depth-perception changes;

  • Peripheral blur;

  • Awareness of lens zones;

  • Head movement adjustments; or

  • Mild discomfort.

Severe, persistent, or worsening symptoms should be reported promptly and may require review by Home Optical or the prescribing provider.

Do not drive, operate machinery, or perform a hazardous activity while your vision feels unsafe.

Home Optical cannot guarantee that every customer will adapt to every lens design.


41. Adjustments and Repairs

Home Optical may provide adjustments or repairs when reasonably possible.

Adjustment and repair services may involve risk, particularly when:

  • A frame is old;

  • Materials are brittle;

  • A frame was previously repaired;

  • Parts are corroded;

  • A frame is severely bent;

  • Screws or hinges are damaged;

  • The frame was purchased elsewhere;

  • Replacement parts are unavailable; or

  • Heat or pressure must be applied.

Before working on a fragile or damaged frame, Home Optical may explain that breakage is possible.

When you authorize work on an already damaged, deteriorated, or third-party frame, Home Optical is not responsible for unavoidable breakage unless caused by negligence or another basis of liability that cannot legally be excluded.

Home Optical may refuse a repair that appears unsafe or impractical.

A repair may alter appearance, finish, alignment, strength, or fit.


42. Fabrication Errors and Remakes

If Home Optical or its laboratory makes a verified fabrication error, Home Optical will use reasonable efforts to correct the error.

Unless a different written policy applies, a claimed fabrication error should be reported within 30 calendar days after delivery or pickup.

Verification may require:

  • Inspection of the eyewear;

  • Lens measurement;

  • Comparison with the written prescription;

  • Confirmation of the approved order;

  • Review of fitting measurements;

  • Provider consultation; or

  • Laboratory evaluation.

A remake may not be free when the issue results from:

  • A new or changed prescription;

  • Incorrect information provided by the customer;

  • A customer-supplied measurement;

  • A changed frame choice;

  • Loss or accidental damage;

  • Normal wear;

  • Improper care;

  • Another party’s alteration;

  • A preference change;

  • Failure to follow instructions; or

  • An issue outside Home Optical’s control.

Any courtesy remake is limited to the terms stated in writing and does not create an unlimited remake obligation.

A remake does not necessarily restart every warranty or return period unless stated in writing.


43. Prescription Changes After Purchase

A prescribing provider may change a prescription after eyewear has been ordered or delivered.

A prescription change does not automatically establish that Home Optical made an error.

The customer is responsible for charges associated with a changed prescription unless:

  • Home Optical caused the error;

  • A written prescription-change benefit applies;

  • A manufacturer or insurer covers the remake;

  • The prescribing provider accepts responsibility; or

  • Applicable law requires another result.

Home Optical may require the updated written prescription before beginning a remake.

Insurance benefits may not cover a second order during the same benefit period.


44. Manufacturer and Product Warranties

Certain Products may carry a manufacturer warranty.

Manufacturer warranties vary and may require:

  • Proof of purchase;

  • Product inspection;

  • Photographs;

  • Return to the manufacturer;

  • Payment of shipping;

  • Use of authorized parts;

  • Compliance with care instructions; or

  • Waiting for the manufacturer’s decision.

Home Optical does not control a manufacturer’s warranty decision.

Unless expressly stated in writing, warranties generally do not cover:

  • Scratches;

  • Accidental damage;

  • Loss;

  • Theft;

  • Chewing by pets;

  • Heat damage;

  • Chemical damage;

  • Improper cleaning;

  • Normal wear;

  • Cosmetic wear;

  • Bent frames;

  • Unauthorized repair;

  • Alteration by another provider;

  • Failure to follow care instructions; or

  • Damage caused by misuse.

No lens is guaranteed to be scratch-proof or unbreakable.

Statutory warranties and rights that cannot legally be disclaimed remain in effect.


45. Shipping, Delivery, and Pickup

Delivery dates are estimates unless Home Optical expressly guarantees a date in writing.

Delays may result from:

  • Prescription verification;

  • Insurance processing;

  • Product availability;

  • Laboratory workload;

  • Manufacturer delay;

  • Quality-control inspection;

  • Weather;

  • Carrier problems;

  • Customs;

  • Holidays;

  • Address errors;

  • Equipment failure;

  • Supply shortages; or

  • Events outside Home Optical’s reasonable control.

Home Optical is not responsible for a reasonable delay caused by such circumstances.

Shipping information

You are responsible for providing a complete and accurate delivery address.

Additional charges may apply when a shipment must be:

  • Redirected;

  • Reshipped;

  • Replaced because of an incorrect address;

  • Held at a carrier location; or

  • Sent using a customer-requested expedited method.

Risk of loss

Unless otherwise required by law, risk of loss passes to you when:

  • The Product is delivered to the address you provided;

  • The Product is handed to you or your authorized recipient;

  • You collect the Product; or

  • A carrier records delivery according to the selected delivery method.

Notify Home Optical promptly of a missing or damaged shipment.

Carrier investigations may be required before replacement or refund.

Authorized pickup

Home Optical may require identification before releasing a Product.

You may authorize another person to collect an order. Home Optical may request:

  • The authorized person’s name;

  • Identification;

  • Order information;

  • Written or electronic authorization; or

  • Confirmation from you.

Home Optical may refuse release when authority or identity cannot reasonably be verified.


46. Unclaimed Orders

Home Optical will make reasonable efforts to notify you when an order is ready.

If an order remains unclaimed for 90 days after the first ready notice, Home Optical may send a final notice.

If the order remains unclaimed for an additional 30 days after final notice, Home Optical may, to the extent permitted by law:

  • Place the Product in storage;

  • Charge a previously disclosed reasonable storage fee;

  • Dispose of the Product;

  • Donate an appropriate Product;

  • Return eligible components to a supplier; or

  • Take another lawful action.

Amounts paid for completed Custom Products are not automatically refundable merely because the Product was not collected.

Disposal of a Product does not automatically eliminate an unpaid balance when the Product was custom-made and Home Optical completed the agreed work.


47. Promotions and Discounts

Promotions may:

  • Have expiration dates;

  • Apply only to selected Products;

  • Require a minimum purchase;

  • Exclude insurance transactions;

  • Exclude examinations;

  • Exclude premium lenses;

  • Exclude designer frames;

  • Be limited to one per person;

  • Be unavailable with another offer;

  • Be limited to available stock; or

  • Be subject to additional written terms.

Unless expressly stated otherwise:

  • Discounts cannot be combined;

  • Promotions have no cash value;

  • Prior purchases are not eligible;

  • Insurance benefits are not cash discounts;

  • A promotion may end when inventory is exhausted; and

  • Home Optical may correct a promotional error.

Home Optical will not cancel a promotion retroactively after an order is accepted unless necessary to correct fraud, an obvious error, or another lawful basis.


48. Gift Cards and Store Credits

If Home Optical offers gift cards or store credits, additional written terms may apply.

Gift cards and store credits:

  • Are not redeemable for cash except where required by law;

  • May not be replaced if lost unless ownership can be verified;

  • May not be used fraudulently;

  • May be subject to restrictions disclosed at issuance; and

  • Cannot be used to purchase another gift card unless permitted.

Insurance credits, manufacturer credits, courtesy adjustments, refunds, and gift cards are not necessarily interchangeable.


PART IV — WARRANTIES, LIABILITY, AND LEGAL TERMS

49. Website Disclaimer

TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND GENERAL WEBSITE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

HOME OPTICAL DOES NOT WARRANT THAT:

  • THE WEBSITE WILL ALWAYS BE AVAILABLE;

  • WEBSITE INFORMATION WILL ALWAYS BE COMPLETE OR ERROR-FREE;

  • EVERY PRODUCT WILL BE AVAILABLE;

  • EVERY APPOINTMENT REQUEST WILL BE ACCEPTED;

  • THE WEBSITE WILL BE COMPATIBLE WITH EVERY DEVICE;

  • THE WEBSITE WILL BE FREE OF SECURITY RISKS; OR

  • USE OF THE WEBSITE WILL PRODUCE A PARTICULAR RESULT.

THIS DISCLAIMER DOES NOT APPLY TO A WARRANTY OR RIGHT THAT CANNOT LEGALLY BE DISCLAIMED.


50. Product and Service Disclaimer

Except for an express written warranty and rights imposed by applicable law, Home Optical disclaims implied warranties to the fullest extent legally permitted, including implied warranties of merchantability and fitness for a particular purpose.

Home Optical does not guarantee:

  • That a particular frame will satisfy personal style preferences;

  • Immediate adaptation to a prescription;

  • That eyewear will prevent every accident or injury;

  • That lenses will never scratch or break;

  • That frames will be indestructible;

  • That insurance will pay;

  • That a manufacturer will approve a warranty claim;

  • That a Product will last for a particular number of years;

  • That tele-optometry will be appropriate for every patient; or

  • That Clinical Services will produce a particular result.

Nothing in these Terms excludes an express written warranty, professional duty, consumer right, or legal remedy that cannot lawfully be excluded.


51. Clinical Disclaimer

Home Optical is not responsible for the independent professional judgment of a licensed healthcare provider when that provider is legally separate from Home Optical.

Clinical questions, diagnosis questions, and prescription questions should be directed to the provider responsible for the examination.

Nothing in these Terms:

  • Limits a healthcare provider’s professional standard of care;

  • Waives a patient right that cannot legally be waived;

  • Excuses professional negligence;

  • Replaces informed consent;

  • Replaces a Notice of Privacy Practices; or

  • Prevents a patient from filing a lawful professional complaint.


52. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HOME OPTICAL WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM:

  • WEBSITE USE;

  • WEBSITE UNAVAILABILITY;

  • LOSS OF DATA;

  • LOST PROFITS;

  • LOST BUSINESS;

  • MISSED OPPORTUNITY;

  • THIRD-PARTY SERVICES;

  • CARRIER DELAY;

  • INSURANCE DENIAL;

  • MANUFACTURER DELAY;

  • CUSTOMER-SUPPLIED INFORMATION;

  • CUSTOMER-SUPPLIED MEASUREMENTS; OR

  • UNAUTHORIZED USE OF AN ACCOUNT.

TO THE FULLEST EXTENT PERMITTED BY LAW, HOME OPTICAL’S TOTAL LIABILITY ARISING FROM A PARTICULAR PRODUCT OR NONCLINICAL SERVICE WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO HOME OPTICAL FOR THE PRODUCT OR SERVICE THAT DIRECTLY GAVE RISE TO THE CLAIM.

These limitations do not apply to the extent prohibited by law, including where applicable to:

  • Fraud;

  • Willful misconduct;

  • Gross negligence;

  • Personal injury caused by legally actionable negligence;

  • Professional malpractice;

  • Violation of a nonwaivable statutory right; or

  • Another liability that cannot legally be limited.

Some jurisdictions do not permit certain exclusions or limitations. In that event, the limitation will apply only to the maximum extent permitted.


53. Your Responsibility and Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold Home Optical and its owners, employees, contractors, and representatives harmless from third-party claims resulting from:

  • Your unlawful use of the Website;

  • Your fraudulent conduct;

  • A forged or unauthorized prescription;

  • Your unauthorized submission of another person’s information;

  • Your violation of another person’s intellectual-property or privacy rights;

  • User content you submit;

  • Your material violation of these Terms; or

  • Damage caused by your intentional misconduct.

This obligation does not require you to indemnify Home Optical for Home Optical’s own negligence, professional malpractice, willful misconduct, or liability that cannot legally be transferred.


54. Events Beyond Reasonable Control

Home Optical will not be responsible for a delay or failure caused by events outside its reasonable control, including:

  • Hurricanes;

  • Floods;

  • Fires;

  • Severe weather;

  • Natural disasters;

  • Public-health emergencies;

  • Epidemics or pandemics;

  • War;

  • Terrorism;

  • Civil unrest;

  • Government orders;

  • Labor disputes;

  • Supply-chain interruptions;

  • Product shortages;

  • Laboratory closures;

  • Manufacturer failures;

  • Carrier delays;

  • Power outages;

  • Internet failures;

  • Cyberattacks;

  • Equipment breakdown;

  • Building closures;

  • Road closures; or

  • Provider emergencies.

Home Optical will use reasonable efforts to communicate and resume performance when practicable.

This provision does not excuse an obligation to issue a refund when a refund is required by applicable law.


55. Informal Dispute Resolution

Before filing a lawsuit concerning a Product, Service, payment, or these Terms, the complaining party should send written notice describing:
